

Changes to the NYSDEC Freshwater Wetland Regulations took effect on January 1, 2025, and are estimated to protect one million additional acres of wetland habitat. Under the new guidance the former regulatory freshwater maps are no longer valid for regulatory purposes. Parcel jurisdictional determinations (JD) may be required for any parcel for which wetland resources are located on site.
Pursuant to the updated regulations, small wetlands may be regulated by the NYSDEC if they meet one of the newly established criteria for wetlands of “unusual importance” and NYSDEC’s 100-foot regulated freshwater adjacent area can be increased for nutrient poor wetlands and vernal pools known to be productive for amphibian breeding.
